COKE REWARDS Program Terms & Conditions
 

Introduction

  1. The "Coke Rewards Program" (formerly the “Coke Unleashed Program”) pursuant to which Members (as defined below) can submit Unique Codes (as defined below) from Program Packs (as defined below) for the purpose of receiving Tokens (as defined below) which can be used for Redemptions (as defined below) via the Online Program (as defined below) during the Program Period (as defined below) (the "Program") is conducted by Coca-Cola South Pacific Pty Ltd, ABN 50 003 029 794, trading as Coca-Cola South Pacific, of Level 9, 40 Mount Street, North Sydney NSW 2060 ("Promoter").

  2. By registering for the Program, individuals accept these terms and conditions ("Conditions"). Information on how to participate in the Program, how to collect Unique Codes (as defined below) associated with the Program, how to accumulate Tokens (as defined below), how to make Redemptions (as defined below) and items or promotions that can be redeemed at www.cokerewards.com.au ("Program Website") or at the Coca-Cola Australia, Coca-Cola Zero Australia and Diet Coke Australia Facebook pages (“Facebook Pages”) (the Program Website and Facebook Pages collectively the “Online Program”), including information at the Online Program, form part of these Conditions.

  3. Notwithstanding any other provisions of these Conditions, the Members (as defined below) under the predecessor rewards program run by the Promoter (being the “Coke Unleashed Program”) will be recognised under the “Coke Rewards Program” and will automatically be deemed Members (as defined below) of the “Coke Rewards Program” on 27 March 2013. Notwithstanding any other provisions of these Conditions, the Tokens (as defined below) that a Member (as defined below) has collected under the predecessor rewards program run by the Promoter (being the “Coke Unleashed Program”) will be recognised under the “Coke Rewards Program” and those Tokens (as defined below) will automatically be credited to the relevant Member’s Token Account (as defined below) on 27 March 2013.

  4. These Conditions relate to the running of the Program only. Other promotions, competitions or programs may be run on the Online Program from time to time and will be governed by separate terms and conditions.

  5. All references to times and dates are to times and dates in Sydney, which may be Australian Eastern Standard Time or Australian Eastern Daylight Time depending on the date.

  6. The word "including" means "including without limitation" and "includes", "included" and "in particular" are also to be understood as being without limitation.

  7. All references to dollars or "$" are references to Australian dollars.

  8. Other grammatical forms of defined words or expressions have corresponding meanings.

Eligibility

  1. Participation in the Program is only open to "Eligible Persons". An "Eligible Person" is an individual who: (i) is a resident of Australia aged 13 years, or older; (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Program; (iii) is not an employee of Coca-Cola Amatil (Aust) Pty Ltd, ABN 68 076 594 119, or its related companies; and (iv) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of an excluded employee. An Eligible Person, who is under 18 years of age, must obtain the permission of a parent or guardian to participate.

Program Period

  1. The "Program Period" is the period deemed to be from 0.00hrs on 1/11/10 until the Program is terminated by the Promoter (or in respect of a part of the Program, until the part of the Program is terminated by the Promoter). The Promoter may terminate the Program, in whole or in part, at any time on giving both:

    1. 1 months' notice of the last date on which Unique Codes (as defined below) may be entered ("Final Code Entry Date"); and

    2. 1 months' notice of the final date on which Redemptions (as defined below) may be made ("Final Redemption Date").

    These notices may be given via the Online Program. The Promoter gave notice via the Online Program that the Final Code Entry Date and the Final Redemption Date is 11:59pm on 21st July 2016.

Membership of the Program and Participation in the Program

  1. Each Eligible Person who wishes to participate in the Program must be or become a member of the Program in accordance with Condition 12 ("Member") during the Program Period.

  2. To register as a Member of the Program, an Eligible Person must use a compatible internet browser to visit the Online Program and follow the directions published there. The Promoter takes no responsibility should an Eligible Person not have the software, hardware or mobile phone plan that would permit access to and use of the Online Program. To commence the process to become a Member of the Program, an Eligible Person must confirm their agreement to these Conditions on the Online Program and must provide:

    1. their first and last names;

    2. their date of birth;

    3. the State or Territory in which they reside and their residential postcode;

    4. a current, valid e-mail address, to which correspondence from the Promoter to the person may be sent; and

    5. all other details requested at the Online Program.

  3. A Member may update details recorded by the Promoter in connection with their membership by revisiting the Online Program and following the relevant instructions published there or by contacting the Coca-Cola Consumer Information Centre on 1800 006 552 or by emailing info@cokerewards.com.au. A Member must not register as a member of the Program more than once during the Program Period. A Member will have a user name and password. The Member will be responsible for the security of this password and user name, and access to and use of the Member's Token Account (as defined below).

  4. The Promoter reserves the right to refuse any Eligible Person's request for registration as a Member, or terminate any Member's Token Account (as defined below), at its absolute discretion, without notice, and may cause the Tokens (as defined below) to be forfeited without the Promoter incurring any liability to the Member.

  5. It is the responsibility of the Member to notify the Promoter of any change to the Member's email address. The Promoter is not responsible for any consequences occurring as a result of the Member failing to update their contact details or otherwise to supply valid contact details.

Unique Codes

  1. To participate in the Program, Members can submit Unique Codes (as defined below) from Program Packs (as defined below) for the purpose of receiving Tokens (as defined below), which can be used for Redemptions (as defined below) via the Online Program during the Program Period. Unique Code (as defined below) submissions received by the Promoter after the Final Code Entry Date will not be accepted.

  2. A "Program Pack" is any 390mL, 450mL, 600mL, 1L, 1.25L, 1.5L, 1.75L or 2L PET Bottle of "Coca-Cola", "Diet Coca-Cola" or "Coca-Cola Zero"; or any; 450mL, 600mL, 1.25L, 1.5L or 2L PET Bottle of “Coca-Cola Vanilla”; or any; 600mL or 2L PET Bottle of “Diet Coca-Cola Vanilla”; or any; 600mL, 1.25L, 1.5L or 2L PET Bottle of “Caffeine Free Diet Coca-Cola”, that:

    1. has been produced for sale, and sold by retail in Australia before the end of the Program Period;

    2. has been specially marked, with the Promoter's authority, to identify it as being included in the Program; and

    3. includes, on the reverse side of the label of the bottle, a unique code that has been determined by the Promoter and affixed to the packaging with its authority (a "Unique Code").

  3. To submit a Unique Code, a Member must log on as a Member at the Online Program and follow the directions published there, including providing their user name and password and the Unique Code from the Program Pack.

  4. If a Unique Code is submitted at the Online Program, the Eligible Person who submitted that Unique Code must be a Member at the time that the Unique Code is submitted or become a Member in accordance with Condition 12 before submitting that Unique Code.

  5. When a Member submits a Unique Code to the Promoter, and that submitted Unique Code is accepted by the Promoter, 10 tokens, or such other amount of tokens specified as applicable for the Program, (each a “Token”) will be credited to that Member's Token account (a "Token Account").

  6. Each Unique Code can only be submitted ONCE. A Member may not submit more than TEN Unique Codes during any period of 7 days starting at the beginning of a Monday and ending at the end of the following Sunday (a "Calendar Week") of the Program Period. A Unique Code that is received exactly on the start of a Calendar Week will be allocated to the Calendar Week that is just commencing (and not the Calendar Week that has just ended).

  7. Only valid Unique Codes from Program Packs will be accepted. Unrecognisable, incomplete, or invalid Unique Codes will not be accepted.

  8. Unique Codes cannot be used in any other program, unless otherwise specified by the Promoter.

  9. A Unique Code received from a Member will only result in the crediting of Tokens to the Member's Token Account if: (i) the code is recognised by the Promoter as a valid Unique Code; and (ii) that Unique Code has not been received by the Promoter before. Following the receipt of a Unique Code meeting those requirements, details of the total number of Tokens in a Member's Token Account will be available for the Member to review at the Online Program.

  10. Subject to Condition 26, if a code received from a Member is not recognised by the Promoter as a Unique Code, or is a Unique Code that has been received by the Promoter before, a communication to that effect (a "Try Again Message") may be displayed on the Program Website or relevant Facebook Page according to the method by which the code was submitted by the Member, shortly after the receipt of the code by the Promoter. The Try Again Message will ask the Member to check the Unique Code on the Program Pack and to resubmit the Unique Code.

  11. If, in a Calendar Week of the Program Period, other than the last Calendar Week of the Program Period, more than TEN purported Unique Code submissions from a Member are received and are not accepted, no further Unique Code submissions will be accepted from that Member until the start of the next Calendar Week. If more than TEN purported Unique Code submissions from a Member are received in the last Calendar Week of the Program Period and are not accepted, no further Unique Code submissions will be accepted from that Member at all. The Promoter may display a communication on the Online Program to the effect that the Member has exceeded their weekly limit of Unique Codes they can submit.

  12. If the provisions of Condition 26 are applied to a Member five times, the Member will be disqualified from further participation in all aspects of the Program, will forfeit all their remaining Tokens and will not be eligible to make any Redemptions (as defined below) via the Online Program or win any prizes in any promotion that may be conducted in conjunction with this Program.

  13. For each Unique Code submitted by a Member, the Member MUST retain the whole of EVERY original Program Pack label that bears the Unique Code submitted, as a Member's entitlement to Tokens, to make Redemptions (as defined below) via the Online Program and to enter promotions and to win prizes that may be conducted in conjunction with this Program, and they may be subject to verification at the absolute discretion of the Promoter. In order to establish any such entitlement, the Promoter may ask the Member to hand over to it (at no cost to the Member) any of the original labels that this Condition requires the Member to retain. A Member MUST comply with any such request within 7 days of it being made. A Member's entitlement to Tokens, to make Redemptions (as defined below) via the Online Program and to enter promotions and to win prizes that may be conducted in conjunction with the Program may be declared void at the absolute discretion of the Promoter if the Member does not comply with the request within 7 days of it being made or if any label bearing a Unique Code that is produced to the Promoter for verification, is illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way, or if the label or the Unique Code it may bear, or any part of any of them, fails the Promoter's verification for any reason.

  14. If in any period of ninety (90) days of the Program Period, a Member's Token Account has:

    1. no Tokens credited to it, or

    2. no Tokens Redeemed (as defined below) at the Online Program,

    ALL the Tokens in that Member's Token Account may be forfeited (i.e. there will then be NO Tokens in that Member's Token Account), at the Promoter's discretion. The Promoter may also terminate the Member's registration in the Program at the Promoter's discretion.

  15. Any Tokens that remain in a Member's Token Account at the expiration of the Final Redemption Date are forfeited at that time. The Promoter will not be liable for any loss suffered whatsoever as a result of the termination of the Program in accordance with these Conditions, including for any Tokens forfeited at the time of termination.

  16. The Promoter may, at any time, cancel any Tokens that are wrongly credited to a Member's Token Account, whether as a result of a Member's breach of these Conditions or an error by the Promoter or for any other reason, including technical issues.

  17. The Promoter, in its absolute discretion, reserves the right, from time to time, to award bonus Tokens to any Member. It is each Member's responsibility to submit their Unique Codes and Redeem (as defined below) their Tokens in sufficient time to allow Redemption (as defined below) of Tokens before the Final Redemption Date. Token Accounts cannot be transferred or assigned from one Member to another Member (or to anyone else), or shared by Members.

  18. Except as provided for in these Conditions, or otherwise specifically authorised by the Promoter, Tokens have no monetary value, or other value, and cannot be redeemed for anything other than for Redemptions (as defined below) from the Online Program, nor redeemed as cash.

  19. A Member's Token Account may only be used by that Member in whose name the account is registered. Multiple individuals cannot share one Member's Token Account.

  20. The Promoter is not liable for any unauthorised use of a Member's Token Account, user name or password by third parties.

Redemptions

  1. During the Program Period:

    1. various goods and services (“Rewards”) available for Redemption (as defined below);

    2. promotions involving Redemption of Tokens for the chance to win goods or services via a game of skill (“Redeemable Promotions”);

    3. Rewards available for Redemption with a bonus automatic entry into a promotion for the chance to win goods or services via a game of chance (“Rewards with Automatic Entry”); and

    4. promotions for the chance to win goods or services via a game of chance (“Game of Chance Promotions”), will be listed from time to time at the Online Program. For the avoidance of doubt, any provisions in these Conditions that refer to “Rewards” are also applicable to Rewards forming part of a “Reward with Automatic Entry” unless expressly stated otherwise. 

  2. Members can redeem their Tokens for Rewards or Redeemable Promotions on the Online Program up until the Final Redemption Date (each a “Redemption” or to “Redeem”).

  3. Only Members may make Redemptions. To make a Redemption, a Member must, during the Program Period, log on to the Online Program as a Member and follow the Redemption instructions. Further conditions that apply to making Redemptions may be posted on the Online Program. Effecting a Redemption constitutes acceptance by the Member of the terms, conditions and limitations set out on the Online Program. It is the Member's responsibility to review and comply with these terms, conditions and limitations prior to Redeeming. The Promoter's obligations are limited to procuring the supply of relevant Rewards by the relevant third party supplier.

  4. A Member may only make a Redemption by redeeming the required number of Tokens from that Member's Token Account for a specific Reward or Redeemable Promotion.

  5. The number of Tokens that must be redeemed to make any particular Redemption will be specified at the Online Program and that number may increase, or decrease, at any time during the Program Period at the discretion of the Promoter.

  6. Rewards, Rewards with Automatic Entry or Redeemable Promotions may be removed from the Online Program without notice. The Promoter gives no undertaking that any Rewards, Rewards with Automatic Entry or Redeemable Promotions will remain on the Online Program, nor that they shall remain available to Members. Access to Rewards, Rewards with Automatic Entry or Redeemable Promotions may be limited in any way by the Promoter, including access for a limited time only, up to a specified quantity only (per Member or across the whole Program) or for certain Members only.

  7. Redemptions will be awarded to the Member in whose name that Token Account is held, subject to these Conditions.

  8. To the extent permitted by law, all terms, conditions, warranties and representations that might otherwise be granted or implied in relation to Rewards, Rewards with Automatic Entry, Redeemable Promotions or related to this Program in any way by law, are hereby expressly excluded. However, these Conditions do not exclude or limit any liability that cannot be excluded or limited, or which cannot be excluded or limited except to a limited extent, by law including liability under the Competition and Consumer Act 2010 (Cth) (or this Act by any other name or its successor legislation). Where such statutory provisions apply, to the extent to which the Promoter is entitled to do so, the Promoter’s liability will be limited at its option to:

    1. in the case of a supply of goods:

      1. the replacement of the goods or the supply of equivalent goods;

      2. the payment of the cost of replacing the goods or of acquiring equivalent goods;

      3. the repair of the goods; or

      4. the payment of the cost of having the goods repaired, and

    2. in the case of services:

      1. the supply of the services again; or

      2. the payment of the cost of having the services supplied again.

    It is a condition of Member's Redemption of any Reward that the Member must comply with all of the conditions of use for the Reward, and subject to law, the requirements of the supplier of the Reward.

  9. Redeemed Tokens are returned to the Promoter upon Redemption and the Member's Token Account will be reduced by the number of Tokens Redeemed.

  10. The Promoter reserves the right to verify the validity of proposed Redemptions and to disentitle any Member who tampers with, or subverts the Redemption process or who submits a Redemption request that is not in accordance with these Conditions.

  11. All expenses incurred by a Member as a result of Redemption from the Online Program are the responsibility of the Member.

Rewards

  1. Rewards that are available for Redemption separately, and not part of a Reward with Automatic Entry, will be available from the “Rewards tab” on the Online Program.

  2. Rewards that are available for Redemption from the Online Program may require that the Member have certain hardware or software to receive or access the Reward. The Promoter is not responsible should the Member not have adequate hardware or software to receive such a Reward.

  3. If a Member Redeems a Reward and that Reward is unavailable despite the Promoter's reasonable endeavours to procure it within Australia, without limiting Condition 41, the Promoter reserves the right to substitute a different item of equal or greater value or to credit the Member's Token Account with the number of Tokens that were deducted for that Redemption.

  4. Any values attributed to any Reward are correct as at the time of publication, but no responsibility is accepted for any variation in the value of any Reward.

  5. At the Promoter's option, Redeemed Rewards will be delivered to the Member in one of the following ways:

    1. by post to the Member's postal address;

    2. by email (by way of voucher or code redeemable through a store, webpage or website of the person the Promoter is partnering with in relation to the particular Reward (“Promotional Partner”)); or

    3. by electronic download from the Online Program or a webpage or website of the Promotional Partner (which may deliver the Reward directly or may deliver a voucher or code redeemable through a store, webpage or website of the Promotional Partner),

    or by such other method outlined on the Online Program.

  6. The Promoter is not liable for any loss, theft of or damage to any Reward sustained in the course of delivery.

  7. Where a Reward is provided by way of a voucher or code redeemable through a Promotional Partner's store, webpage or website, any costs in excess of the voucher or code value and any ancillary costs associated with redeeming the voucher or code are the responsibility of the Member. The Promoter is not liable for vouchers or codes that have been lost, stolen, forged, damaged or tampered with in any way. Redemption of the voucher or code may be subject to terms and conditions specified on or supplied with the voucher or code, including a validity period or date of expiry.

Promotions

  1. Rewards with Automatic Entry, Redeemable Promotions and Game of Chance Promotions will be available from time to time from the “Promotions tab” on the Online Program.

  2. Rewards with Automatic Entry will be clearly marked on the Online Program and during the period of the relevant promotion the Rewards forming part of a Reward with Automatic Entry will not be able to be Redeemed without the bonus automatic entry into the relevant promotion for the chance to win goods or services via a game of chance that is provided in conjunction with that Reward. However once the promotion relating to the Reward with Automatic Entry is over, the Reward forming part of the Reward with Automatic Entry will be available for Redemption on its own via the “Rewards tab” on the Online Program.

  3. Redeemable Promotions and Games of Chance Promotions will also be clearly marked on the Online Program.

  4. Selection of the goods or services that form particular Rewards, selection of the goods or services that form prizes in promotions conducted in conjunction with the Program, the manner in which promotions conducted in conjunction with the Program are run and the timing of the provision of Rewards and of promotions run in conjunction with the Program, is wholly at the discretion of the Promoter.

  5. The promotions which will be run from time to time by the Promoter in connection with the Program are each subject to their own sets of specific terms and conditions, as are all other promotions run in connection with the Online Program which may be implemented from time to time by the Promoter. A Member's election to Redeem a Reward as a part of a Reward with Automatic Entry or Redeem Tokens as part of a Redeemable Promotion, constitutes acceptance by the Member of the specific terms and conditions for the relevant promotion. It is the Member's responsibility to review and comply with these terms and conditions prior to electing to Redeem a Reward as a part of a Reward with Automatic Entry or Redeem Tokens as part of a Redeemable Promotion. Each full set of terms and conditions for the current promotions being run by the Promoter in connection with the Program can be obtained at the Online Program.

General Conditions

  1. The Online Program is in no way sponsored, endorsed or administered by, or associated with, Facebook.

  2. Without limiting the operation of Condition 49, from time to time the Promoter may vary these Conditions or the Program in any way, in whole or in part at any time, provided that 1 months' notice is given if the change lessens the rights of any Member. Notice may be given via the Online Program. Continued use of the Online Program following changes to these Conditions will be deemed acceptance of those changes.

  3. If for any reason the conduct or operation of the Program is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Program.

  4. If a Member tampers with, or subverts, the processes relating to participation in the Program, or may benefit from such tampering or subversion by any other person, the Promoter reserves the right in its sole discretion to disqualify that Member. The Promoter reserves the right to verify the details of the Member, and request identification to establish their identity.

  5. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failures, theft or destruction or unauthorized access to, or alteration or non-receipt of Member's communications (including submissions of Unique Codes, and the making of Redemptions). The Promoter is not responsible for any problems or technical malfunctions (such as problems with telephone networks or lines, computer systems or software or internet service providers) or any failure of any internet communication or telephone communication to be received by the Promoter (whether as a result of technical problems or traffic congestion on any carrier network, on the internet or at any website). To the full extent permitted by law, the Promoter is not liable for any injury or damage to any Member's (or any other person's) computer or resulting from or otherwise relating to participation in this Program (including by downloading materials relating to this Program), or resulting from participation in or use of any prize, Reward, Redeemable Promotion or Reward with Automatic Entry.

  6. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROGRAM OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS PROGRAM MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.

  7. Unless otherwise stipulated, rights to make Redemptions, and to receive any prizes, Rewards or entry into promotions as part of a Redeemable Promotion or Reward with Automatic Entry, are not transferable or exchangeable and cannot be taken as cash. Tokens have no value outside of this Program regardless of their allocation to any prize, Reward or Redeemable Promotion.

  8. All of the Promoter's decisions are final and no correspondence will be entered into.

  9. The Promoter accepts no responsibility for any tax liability incurred as a result of a Member making a Redemption of any Reward or Redeemable Promotion or winning a prize. Members should obtain independent tax and financial advice.

  10. No responsibility is accepted for late, lost, or misdirected submission of Unique Codes, use of any Tokens, or Redemption of any Reward or Redeemable Promotion.

  11. Members who make a Redemption or win a prize in any promotion conducted in conjunction with the Program may be required to agree to and sign an eligibility form confirming their eligibility to make that Redemption or accept that prize (or if under 18 years of age, have their parent or guardian sign such a form on their behalf). The Promoter reserves the right to verify the age and identity of a Member prior to supplying a prize, Reward or entry into a promotion as part of a Redeemable Promotion or Reward with Automatic Entry.

  12. The Promoter is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilised in this Program which may occur in the course of the administration of this Program.

  13. Any costs associated with accessing the Online Program are the responsibility of the person seeking access and are dependent on the internet service provider used. 

  14. To the full extent permitted by law, the Promoter and its related companies, Coca-Cola Amatil (Aust) Pty Ltd (ABN 68 076 594 119) and its related companies, all their agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any person in connection with the Program, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these Conditions is intended to exclude, restrict or modify a person's rights under the Competition and Consumer Act 2010 (Cth) (or this Act by any other name or its successor legislation).

  15. Members are able to elect to receive electronic newsletters from the Promoter and electronic Program-related updates including references to prizes and Rewards and their respective manufacturers or providers. All Members will be given the opportunity to opt out if they do not wish to receive future newsletter and update emails. However, Members consent to receive communications from the Promoter or its delegate relating to the Program, their Token Account or Token Account balance, or their Membership, as the Promoter deems necessary for the administration of the Program, and the Promoter may deem that a Member electing to opt out of such communications wishes to forfeit participation in the Program.

  16. Members' personal information will be collected by or on behalf of the Promoter to enable it to administer and promote the Program and the winners of any promotion conducted in conjunction with the Program. The personal information of Members may be provided to others assisting in the conduct of the Program, including the Program administrator, suppliers and deliverers, and to authorities that regulate the Program. Consumers may contact the Promoter via the Online Program or by calling the toll free number 1800 006 552 or by emailing info@cokerewards.com.au to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If a Member does not provide accurate personal information, the Promoter may determine that they are not eligible to make a Redemption or win a prize. Visit www.cokerewards.com.au to view the Promoter's privacy policy. Members acknowledge that their personal information may be supplied to organisations outside of Australia and they provide their consent for this to occur by participating in the Program.

  17. All trademarks are protected from commercial use by third parties. Members must not use any registered or unregistered trade marks on the Online Program without either the Promoter's prior written permission or the prior written permission of the relevant trade mark owner.

  18. Members should assume that everything they see or read on the Online Program is copyrighted unless otherwise noted and may not be used except as provided in these Conditions or in the text on the Online Program without the written permission of the Promoter. The Promoter does not warrant or represent that the Member's use of materials displayed on the Online Program will not infringe rights of third parties.

  19. Images of people or places displayed on the Online Program are either the property of, or used with permission by, the Promoter. The use of these images by Members, or anyone else authorised by a Member, is prohibited unless specifically permitted by these Conditions or specific permission provided elsewhere on the Online Program. Any unauthorised use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, regulations and statutes.

  20. Members are also advised that the Promoter or its affiliated or related corporations, in their sole discretion, may choose to aggressively enforce its or its affiliated or related corporations' intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution or to refer violators to the appropriate authorities in the relevant jurisdiction.

Registered Mobile Phone Number

  1. Except where expressly set out in Conditions 79 – 90, the following Conditions 79 – 90 operate in conjunction with, or not to the derogation of, the other Conditions in these Conditions. Conditions 79 – 90 are effective from 27 March 2013 until 27 March 2014 and apply only in relation to any Eligible Person or Member who enters a Unique Code that is from a Program Pack that is labelled with the “Coke Unleashed Program” as opposed to the “Coke Rewards Program” (an “SMS Unique Code”). From 27 March 2014, Conditions 79 – 90 will cease to have any force or effect and will be deleted from these Conditions. For the avoidance of doubt, Unique Codes that are not SMS Unique Codes are not able to be submitted by SMS and must be submitted at the Online Program.

  2. A Member may register the Member's mobile phone number at the Online Program ("Registered Mobile Phone Number”) if they wish to enter SMS Unique Codes via their Registered Mobile Phone Number.

  3. If the Member registers their mobile phone as a Registered Mobile Phone Number for the purposes of entering SMS Unique Codes, they will be sent an SMS message from the Promoter, which the Member must reply to in accordance with the directions to complete the registration of their Registered Mobile Phone Number.

  4. There may be SMS costs associated with submitting SMS Unique Codes or registering a Registered Mobile Phone Number. The SMS Entry Number (as defined below) is a premium SMS number. The cost of each SMS message sent to the SMS Entry Number (as defined below) will be capped at $0.25, including GST. If you have problems submitting an SMS Unique Code by SMS or if you have queries or complaints regarding SMS or an SMS Unique Code, contact the SMS help desk on 1800 006 552 or by emailing info@cokerewards.com.au.

  5. Eligible Persons wishing to enter SMS Unique Codes must obtain the consent of the bill payer prior to sending any SMS message. To send an SMS to the SMS Entry Number (as defined below), such Eligible Persons must use a mobile phone and carrier service with the ability to send SMS messages to premium SMS phone numbers. Individuals should check with their carrier prior to sending any SMS message. Messages sent via SMS are deemed to be received at the time of receipt into the promotional database and NOT at the time of the transmission by the individual. SMS messages sent via the internet, or via other methods other than via a mobile phone, will be deemed invalid. 

  6. It is the responsibility of the Member to notify the Promoter of any change to the Member's Registered Mobile Phone Number if they have one. The Promoter is not responsible for any consequences occurring as a result of the Member failing to update their contact details or otherwise to supply valid contact details.

  7. Despite Condition 18, to submit an SMS Unique Code, a Member may also use a mobile phone with the Member's Registered Mobile Phone Number to SMS the SMS Unique Code from the Program Pack to 193193 ("SMS Entry Number") - Optus & Virgin $0.25 including GST per msg sent Telstra & VHA FREE. Each SMS Unique Code must be sent in a separate SMS.

  8. In addition to Condition 19, if an SMS Unique Code is submitted by SMS, the Eligible Person who submitted that SMS Unique Code must:

    1. be a Member with a Registered Mobile Phone Number at the time that SMS Unique Code was received by the Promoter, or

    2. become a Member and register their Registered Mobile Phone Number in accordance with Conditions 12, 80, and 81 within 72 hours after the SMS Unique Code was received by the Promoter.

  9. If a person who is not a Member with a Registered Mobile Phone Number submits an SMS Unique Code by SMS:

    1. they will NOT be allocated any Tokens for that SMS Unique Code until they comply with the requirements of Condition 86 (ii); and

    2. as provided for in Condition 21, the SMS Unique Code cannot be submitted again by SMS or at the Online Program, by that person or by anyone else.

  10. This Condition 88 applies to the exclusion of Condition 25 if a Member submitted a code to the Promoter by SMS. Subject to Condition 26, if a Member submitted a code to the Promoter by SMS and the code received from the Member is not recognised by the Promoter as an SMS Unique Code, or is an SMS Unique Code that has been received by the Promoter before, a communication to that effect (an "SMS Try Again Message") may be sent by SMS shortly after the receipt of the code by the Promoter. The SMS Try Again Message will ask the Member to check the SMS Unique Code on the Program Pack and to resubmit the SMS Unique Code.

  11. For the purposes of Conditions 26 and 27, if a Member has a Registered Mobile Phone Number, instead of displaying a communication on the Online Program, the Promoter may send a communication by SMS to the effect that the Member has exceeded their weekly limit of Unique Codes they can submit.

  12. The Member acknowledges that a message sent via SMS by the Promoter in accordance with these Conditions may not be received by the Member, due to network coverage and availability, or because the Member's mobile phone's memory is full, or other technical issues. If a Member or Eligible Person resubmits an SMS Unique Code via SMS, then the Member or Eligible Person may incur another SMS charge. The Member acknowledges that it may receive additional SMS messages in connection with the Program or any promotion conducted in conjunction with the Program.
